Terms of Service

Sarwise (a trade name of BOLBUY) · Goudplevier 96, 5348 ZG Oss, Netherlands · Chamber of Commerce (KvK) 68734581 · VAT NL002463953B54 · Last updated: 18 October 2026

1. About these terms

These terms apply to every subscription, trial and setup service that Sarwise ("we") provides to a business ("you"). Sarwise is a trade name of BOLBUY, registered with the Dutch Chamber of Commerce (KvK) under number 68734581, Goudplevier 96, 5348 ZG Oss, the Netherlands. Contact: info@sarwise.com.

Sarwise is sold only to officially registered businesses, including self-employed professionals and one-person businesses. At checkout you give your business name and your Chamber of Commerce, VAT or tax registration number (or the equivalent in your country; where no such number exists, we may ask for other proof of registration and approve the order manually), and you confirm that you are buying for your trade, business, craft or profession and not as a consumer. We keep this confirmation with your order.

2. Ordering and payment

Our order process is handled by our online reseller Paddle.com. Paddle is the Merchant of Record for all orders: it processes payments, charges the applicable VAT or sales tax, issues invoices and handles payment-related questions. Paddle is the seller and Merchant of Record for your purchase, and its Buyer Terms and Refund Policy govern the transaction, including applicable refunds. These terms govern the Sarwise service itself. Nothing in these terms limits rights that mandatory law gives you.

Prices are shown on our website at the time of ordering, per location, excluding VAT. Subscriptions are paid in advance per month or per year.

3. The service

Sarwise provides an AI assistant that answers your customers on WhatsApp and manages appointments or reservations according to the information you give us (services, prices, opening hours, staff). You stay responsible for that information being correct and up to date. The assistant offers only what you have set up, and you can change or cancel any booking.

The assistant always tells your customers that it is an AI, as the EU AI Act requires. It hands the conversation to you when it cannot help or when a customer asks for a person.

The service depends on third parties, in particular Meta (WhatsApp Business Platform) and Anthropic (AI model). We do our best to keep the service available, but we cannot guarantee uninterrupted operation. If a third party changes its terms or prices in a way that affects the service, we will inform you.

4. Free trial

5. Fair use

Each plan includes a monthly number of conversations and, where stated, reminders (Starter: 500 conversations; Pro: 1,000 conversations and 500 reminders). A conversation is the exchange with one customer; a new conversation starts when that customer writes after at least 24 hours without messages. The limits are soft: the assistant does not stop and we never charge extra automatically. If you exceed the limit for two months in a row, we will contact you to agree on a suitable plan. If no agreement is reached, either party may end the subscription at the end of the current period.

6. Your obligations

7. Personal data

For your customers' data you are the controller and we act as your processor. A data processing agreement (verwerkersovereenkomst) forms part of every subscription and is accepted when you order. Our Privacy Policy describes the data, service providers and retention periods.

8. Term, cancellation and renewal

Subscriptions renew automatically for the same period. How and when you can cancel is described in our Refund & Cancellation Policy, which forms part of these terms.

9. End of the service

When a subscription ends, the assistant stops answering on your number. You can ask us for an export of your appointments within 30 days. After 30 days we delete your data, except where the law requires us to keep it (for example invoicing records).

10. Price changes

We may change our prices. We will tell you at least 30 days in advance by email. The new price applies from your next billing period. If you do not agree, you can cancel before that period starts.

11. Liability

We are not liable for indirect or consequential damage, such as lost turnover, lost profit or missed appointments. Our total liability is limited to the fees paid to Paddle for Sarwise services during the 3 months before the event that caused the damage. These limits do not apply in case of intent or gross negligence.

12. Force majeure

We are not liable for failures caused by circumstances beyond our reasonable control, including outages or changes at Meta (WhatsApp), Anthropic or other third-party providers, internet or power failures, cyberattacks and government measures. We will inform you and restore the service as soon as reasonably possible. If such a situation lasts longer than 30 days, either party may end the subscription.

13. Suspension

We may suspend the service if payment fails, if the service is used in breach of these terms or WhatsApp's policies, or if this is needed to prevent damage to the service or to others. Where possible we inform you first and give you the chance to resolve the issue.

14. Changes to these terms

We may update these terms. We will email you about material changes at least 30 days before they take effect.

15. Governing law

These terms are governed by Dutch law. Disputes are submitted to the competent court in the district of Oost-Brabant, the Netherlands.
